Fortress K9 LLC is not responsible for the actions, advice, training methods, omissions, conduct, or results of any third party.

To the fullest extent permitted by law, Fortress K9 LLC is not liable for injuries, damages, losses, claims, or consequences arising from your use, misuse, interpretation, or attempted application of information found on this website or in Fortress K9 LLC materials.

Every dog, handler, family, property, and security concern is different.

Products, Services, and Purchases

Fortress K9 LLC may offer trained dogs, puppies, Family Protection Plans, books, digital products, educational products, merchandise, in-person training, consultations, and related services.

Product descriptions, pricing, availability, and offers may change without notice.

Fortress K9 LLC reserves the right to refuse service, refuse a sale, cancel an order, decline a client, or determine that a product or service is not appropriate for a particular buyer, family, dog, or situation.

Dog Sales and Signed Contracts Control

All trained dog sales, puppy sales, deposits, guarantees, transfers, timelines, payment terms, training expectations, delivery terms, health terms, client responsibilities, and dispute terms are controlled by the signed written contract or purchase agreement for that dog.

If there is a conflict between these website Terms and a signed dog purchase agreement, the signed dog purchase agreement controls for that dog transaction.

Dog deposits are non-refundable unless a signed written agreement states otherwise.

By making a dog deposit or payment, you acknowledge that dogs involve limited availability, selection, training, placement preparation, opportunity cost, and reserved time.

Family Protection Plan

The Family Protection Plan is a custom written planning service based on information you provide.

It is intended to help identify security gaps, improve family readiness, and create practical safety recommendations.

It is not legal advice, law enforcement advice, security consulting certification, a guarantee of safety, or a substitute for professional services where such services are required.

You are responsible for the accuracy of the information you provide and for any actions you take based on the plan.

Refunds and Returns

Refunds, returns, cancellations, deposits, digital products, books, merchandise, training services, Family Protection Plans, and product-specific return issues are governed by the Fortress K9 LLC Refund & Return Policy, any product-specific terms, and any signed written agreement that applies.

Dog deposits are non-refundable unless otherwise stated in the applicable signed contract.

User-Submitted Information

If you submit forms, questionnaires, messages, photos, videos, files, or other information to Fortress K9 LLC, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it.

You grant Fortress K9 LLC permission to use submitted information as necessary to respond to you, provide requested services, prepare custom plans, process purchases, evaluate fit, maintain business records, and communicate with you.

Do not submit sensitive information unless it is necessary for the service you are requesting and you are comfortable sharing it with Fortress K9 LLC.

Limitation of Liability

To the fullest extent permitted by law, Fortress K9 LLC shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or similar damages, including but not limited to loss of income, loss of opportunity, emotional distress, reputational harm, personal injury claims arising from user action, dog handling decisions, training decisions, reliance on educational materials, third-party conduct, property damage, or security-related outcomes.

To the fullest extent permitted by law, any recovery against Fortress K9 LLC shall be limited to the amount actually paid by the claimant to Fortress K9 LLC for the specific product or service giving rise to the claim.

If the claimant paid nothing to Fortress K9 LLC, the maximum recovery shall be zero dollars unless prohibited by law.

Attorney’s Fees and Costs

If Fortress K9 LLC is required to defend against a claim arising from your misuse of the website, reliance on educational content, violation of these Terms, unauthorized use of Fortress K9 LLC materials, dog handling decisions, training decisions, or actions connected to your use of Fortress K9 LLC information, products, or services, you agree to reimburse Fortress K9 LLC for reasonable attorney’s fees, arbitration costs, court costs, and defense expenses to the fullest extent permitted by law.

Binding Arbitration

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to this website, Fortress K9 LLC products, services, educational materials, purchases, communications, dogs, training, Family Protection Plans, digital products, or these Terms shall be resolved through binding arbitration in Florida rather than in court.

The arbitrator shall have authority to resolve disputes related to these Terms, except where Fortress K9 LLC seeks injunctive or equitable relief to protect intellectual property, confidential information, business interests, safety-related concerns, or unauthorized use of its materials.

You and Fortress K9 LLC waive the right to a jury trial to the fullest extent permitted by law.

The arbitration shall be conducted in Florida unless Fortress K9 LLC agrees otherwise in writing.

Each party shall be responsible for its own costs unless the arbitrator determines otherwise, a written agreement provides otherwise, or applicable law requires otherwise.

Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute with Fortress K9 LLC must be brought only in your individual capacity.

You agree not to bring or participate in any class action, collective action, representative action, private attorney general action, or consolidated proceeding against Fortress K9 LLC.

Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

If any dispute is not subject to arbitration, you agree that it shall be handled in the appropriate state or federal court located in Florida, unless otherwise required by law.

Contract Reasonableness and No Unconscionability Acknowledgment

By using this website, purchasing from Fortress K9 LLC, submitting forms, accessing materials, or engaging with Fortress K9 LLC products or services, you acknowledge and agree that these Terms are reasonable, clearly stated, and voluntarily accepted.
